BY SUBMITTING YOUR WORK YOU ACKNOWLEDGE THAT YOU UNDERSTAND THE FOLLOWING. - updated 16 April 2008Definitions: Within this agreement the word "Work" refers to any material submitted by writers or artists for publication in Something Wicked.
The word "You" or "Your" refers to any artist or writer who submits Work for publication. We reserve the right to ammend this agreement at any time and without notice so please always check this page before submitting content. LICENSES WE PURCHASE: By submitting your Work you automatically agree to the following. The following is only put into place once your work has been accepted for publication.
You acknowledge that you are the sole owner of the copyright and all related materials. Any copyright infringements will be the sole responsibility of the author/artist.
Furthermore Inkless Media, Something Wicked and anyone affiliated with us at present or in the future will not be held liable for any legal issues resulting from copyright infringements that may arise from the publication of unlawful submissions.
COPYRIGHT: As per South African copyright law 1978, Section 21 (1) (1) (c), copyright is retained by the author/artist.
If your Work is accepted for publication then you agree to grant Inkless Media and Something Wicked, once-off publication, First South African Rights Only. From Issue 6 we will also be publishing Something Wicked online and through a pdf download so we will further require Single-Print, Non-Exclusive World-Wide Electronic Media Rights. Select stories may be published in their entirety on the website (with the author's permission) for at least the shelf-life of the issue and possibly archived indefinitely. Should the author require us to remove their story from the site for whatever reason we will do so immeadiately upon written request. If your story is accepted as the Bonus eMagazine Story then we will only require Single-Print, Non-Exclusive World-Wide Electronic Media Rights. A Contract will be sent to Authors whose work is accepted for publication. Commissioned Art: All art commissioned specifically by Something Wicked for publication will become the licensed property of Something Wicked and Inkless Media. However, the copyright and the original artwork will remain the artists property and Something Wicked will NEVER display the art without crediting the artist. The Artist also retains the right to reproduce, sell, print, display and alter his or her art in any way the artist sees fit so long as this does not violate the licenses granted to Something Wicked, (i.e. you can't sell it to another magazine but you can sell it to an art gallery). Should Something Wicked re-print an issue or collect the art in an anthology Something Wicked will re-pay the artist the amount agreed upon in the original commissioning brief for the re-use. Something Wicked also reserves the right to prepare derivative works (including, but not limited to, flyers, posters, t-shirts and promotional material) of such Work, and that the artist gives us permission to archive their work online indefinitely. The above applies only to work commissioned and NOT to work submitted as part of your submission. In terms with standard South African publishing practice payment will be made within 30 days of Publication. Please contact us if you have any questions.
